WWCrafters.com's Terms of Use Agreement

By using the WWCrafters.com web site ("WWCrafters.com"), you are agreeing to be bound by the following terms and conditions (the "Terms of Use" or the "Agreement").

General Terms

• You are responsible for keeping your password secure, if you hand your password out and someone hijacks your account, WWCrafters is not responsible for any harm or damage they may cause.
• You must be 18 years and older to use this site or have permission from a legal guardian. You are responsible for any activity that occurs under your username WWCrafters will not assume responsibility for any activity that occurs resulting from its members.
• You must not abuse, threaten, or intimidate other WWCrafters.com users on the site, forum or in chat.
• You may not use the WWCrafters.com service for any illegal or unauthorized purpose. If any illegal or unauthorized content is listed it will be deleted and your account immediately suspended. You will not receive a refund for your listing.
• You are completely responsible for your conduct while operating here on WWCrafters.com and any data, text, information, screen names, graphics, photos, profiles, links ("Content") that you submit, post and display on the WWCrafters.com service.
• You must not, in the use of WWCrafters.com, violate any laws in your jurisdiction.

Violation of any of these agreements will result in the termination of your WWCrafters.com account. While WWCrafters.com prohibits such conduct and content on its site, you understand and agree that WWCrafters.com is a venue and as such is not responsible for the Content posted on its web site and you use the WWCrafters.com service at your own risk.

General Conditions

• WWCrafters.com reserves the right to alter these Terms of Use at any time without any prior written notice.
• WWCrafters.com reserves the right to refuse service to anyone for any reason at any time.
• WWCrafters.com may, but has no obligation to, remove content ("content" includes items, item descriptions, and information submitted in the forums) and accounts containing content that WWCrafters.com determine in WWCrafters.com's sole discretion are unlawful, offensive or threatening we also reserve the right to remove any and all listings that are not handmade.
• By uploading images and item description content to WWCrafters.com, you agree to allow other WWCrafters.com users to view them and you agree to allow WWCrafters.com to display the images and content on WWCrafters.com and store the images, item description, profile and other content.

You must agree with and accept all of the terms and conditions contained the Terms of Use, the Privacy Policy, the DO's & DON'Ts of WWCrafters.com before you may become a member of WWCrafters.com.

WWCrafters.com may change the Terms of Use and any other policy documents and community guidelines, at any time. The Terms of Use is effective upon acceptance in registration for new registering users, and is otherwise effective on August 27, 2007 for all users.

Membership Eligibility

WWCrafters.com's services are available only to, and may only be used by individuals who can form legally binding contracts under applicable law so that you may obtain access to PaypalTM for secured online payments to fill your account. WWCrafters.com's services are not available to children (persons under the age of 18). If you are a under the age of 18, you can use this service only under the supervision of your parents or guardians. If you do not qualify, please do not use WWCrafters.com or your account will be terminated.

Fees and Services

Joining and setting up a shop on WWCrafters.com is free. WWCrafters.com charges fees for listing items for sale or Marketplace through WWCrafters.com. When you list an item you have an opportunity to review and accept the fees that you will be charged they can include any of the optional fees we have for upgrading your listing. WWCrafters.com's Do's and Dont's and Privacy Policy is available on the website. In the event WWCrafters.com introduces a new service or listing type, the fees for that service are effective at the launch of the service. All fees are in U.S. Dollars (USD). You are responsible for paying all fees associated with using WWCrafters.com.

WWCrafters.com is An Online Marketplace

WWCrafters.com is not a retailer. Although WWCrafters.com is commonly referred to as an online Marketplace, it is important to realize that WWCrafters.com is not a traditional "retailer." Instead, WWCrafters.com acts as a venue to allow an individual who complies with the DO's & DON'Ts of WWCrafters.com to offer, sell, and buy certain handmade goods which comply with the DO's & DON'Ts of WWCrafters.com within a fixed price format. WWCrafters.com is not involved in the actual transaction between buyers and sellers. As a result, WWCrafters.com has no control over the quality, safety or legality of the items advertised, the truth or accuracy of the listings, the ability of sellers to sell items or the ability of buyers to pay for items and we assume no liability for such stated listings. WWCrafters.com cannot ensure that a buyer or seller will actually complete a transaction or that a buyer will make payment. Consequently, WWCrafters.com does not transfer legal ownership of items from the seller to the buyer.

Feedback

WWCrafters.com has established a user-initiated feedback system to help you evaluate with whom you are dealing. Appropriate feedback should be given when a transaction takes place as it is a very useful tool within our community. Please do not use feedback to slander or misrepresent a person's religious beliefs or any personal content. Feedback is meant to be used for the buyer/seller experience with the item listed, how the transaction was handled and your level of satisfaction with such transaction.

Resolution of Disputes

WWCrafters.com's ultimate goal is to make you happy. In the event a dispute arises between you and another user of WWCrafters.com, please do all that you can to work it out amicably. If however this action brings no results, please email WWCrafters.com at admin@wwcrafters.com and we will work quickly towards a solution. Do not take further matters into your own hands.

Disputes between you and WWCrafters.com regarding WWCrafters.com's services may be reported to Customer Support by emailing admin@wwcrafters.com.

Release

Because WWCrafters.com is an online Craft/E-Mall & Marketplace venue and not a retailer, in the event that you have a dispute with one or more users, you release WWCrafters.com (and WWCrafters.com's officers, directors, agents, subsidiaries, and employees) from any and all claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes.

Buyer Obligation

A buyer is obligated to complete the transaction of a purchase of an item on WWCrafters.com in any shop within two (2) days. A buyer is obligated to immediately pay in full if using PayPal by clicking the "Pay Now" button during checkout. A buyer must submit payment in full within two (2) days if paying by personal check, money order or "other" and must send the seller an email or Private Message to notify them that the payment is in the mail, within two (2) days of the transaction.

Seller Obligation

A seller must abide by all of WWCrafters.com's policies and the seller's own individual shop policies and sell and the item as described. A seller must abide by the seller's own individual policies when dealing with other issues, such as issues of damage and returns.

Billing

In order for WWCrafters.com to allow sellers to list they must have money in their account. The way to obtain money is to make a purchase is by going to My Account and click on "Add Money". You will be able to choose how much to put into your account and then proceed. That will bring you to the secured Paypal^TM website where you can complete your transaction. We now also have Google Checkout^TM available for your convenienceTo view the balance in your account click on My Account.

Listing and Selling

Purchasing a Store subscription enables you to no listing fees and also reduces the end of sale fees. If you have a WWCrafters.com store you are obligated to list items in your store. If your store is empty for more than 10 days it will be suspended and no refunds will be issued.

Listing Description: You must be legally able to sell the item(s) you list for sale on the Site. All listed items must be listed in an appropriate category. You must properly describe your item and all terms of sale on the listing page of the Site. If the "in stock" quantity is more than one. Each unique item must have its own listing.

Shop Policies: All sellers are urged to outline individual shop policies (in their personal "MY Store") for their WWCrafters.com shop. These policies include, for example shipping, returns, payment and selling policies. Please be very clear and descriptive in your personal policies so that confusion and possible confrontation is not likely occur.

Binding Sale: All sales are binding. If you, as a seller, receive a purchase request (order) you are obligated to complete the transaction with the buyer in a prompt manner and courteous manner, unless there is an exceptional circumstance, such as: (a) the buyer fails to meet the terms of your listing (such as payment method), or
(b) you cannot authenticate the buyer's identity. In these instances you must contact your buyer view Private Message and Email to notify them accordingly.

Service Usage

Competing services such as "Brick and Mortar" Craft Malls or online based Craft Malls are not allowed to sell their vendor's products through our service. Each vendor must register their own account with us.

You understand that WWCrafters.com has no involvement in the transaction between you and the buyer. You will be responsible to promptly and properly deliver the purchased products in accordance with the terms of the purchase. You will also be responsible for directly handling any questions or concerns expressed by the buyer of such products.

WWCrafters.com reserves the right, but has no obligation, to monitor activity on WWCrafters.com, including the investigation of any violation or purported violation of its rules. As a result of such investigation, WWCrafters.com, in its sole and absolute discretion, may take such action as it deems necessary to cause compliance with its rules and any governing law, including restricting, limiting or denying your access to WWCrafters.com, causing the editing or removal of a product page, or issuing a written warning of a rules violation and requiring that such violation be timely corrected. The following are examples of violations that WWCrafters.com, in its sole and absolute discretion, may take action upon:

*Referring visitors to another web site
*Posting products that are unrelated to the Arts and Crafts industry
*Posting material that is deemed as objectionable content
*Rude or unprofessional communication with customers or WWCrafters.com staff.

Liability Limit

IN NO EVENT SHALL WWCrafters.com, AND (AS APPLICABLE) WWCrafters.com SUBSIDIARIES, OFFICERS, DIRECTORS, EMPLOYEES OR WWCrafters.com SUPPLIERS BE LIABLE FOR LOST PROFITS OR ANY SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH OUR SITE, OUR SERVICES OR THIS AGREEMENT (HOWEVER ARISING, INCLUDING NEGLIGENCE).

WWCrafters.com LIABILITY, AND (AS APPLICABLE) THE LIABILITY OF WWCrafters.com SUBSIDIARIES, OFFICERS, DIRECTORS, EMPLOYEES, AND SUPPLIERS, TO YOU OR ANY THIRD PARTIES IN ANY CIRCUMSTANCE IS LIMITED TO THE GREATER OF (A) THE AMOUNT OF FEES YOU PAY TO WWCrafters.com IN THE 12 MONTHS PRIOR TO THE ACTION GIVING RISE TO LIABILITY, AND (B) $100. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.

Indemnity

You understand that because WWCrafters.com cannot and does not attempt to verify the information you post on WWCrafters.com or provide to any prospective purchaser concerning your products, or monitor your compliance with the terms of this agreement, and because WWCrafters.com is not involved in the sales transaction or the delivery of the products purchased, WWCrafters.com cannot and will not accept any liability that results from the display, offering for sale, sale or delivery of your products through WWCrafters.com. Therefore, you agree to defend, indemnify and hold harmless WWCrafters.com, its officers, directors, employees, affiliates, agents, attorneys, and any other related entity, from and against any and all demands, claims, actions, causes of action, liabilities, suits, proceedings, investigations or inquiries, or any settlement thereto, and all related expenses, including, but not limited, to all litigation expenses (including reasonable attorneys' fees and court costs) and settlement amounts, as well as all special and consequential damages and damage to WWCrafters.com's goodwill and reputation that arises from or in connection with the display, sale, transfer or use of your products displayed upon or acquired through WWCrafters.com.

Notices

Except as explicitly stated otherwise, any notices shall be given by postal mail to WWCrafters.com Attn: WWCrafters; PO Box 752, Quakertown, PA 18951. Notice shall be deemed given 24 hours after email is sent, unless the sending party is notified that the email address is invalid. Alternatively, WWCrafters.com may give you notice by certified mail, to the address provided to WWCrafters.com during the registration process. In such case, notice shall be deemed given 3 days after the date of mailing.
